Como Um Nativo Forum and Community Rules

1. Welcome and Scope

Como Um Nativo's forums and community spaces are intended to allow users to ask questions, share experiences and knowledge, practise, and participate in discussions related to the Company's activities and learning.

These Rules apply to the general community forum, professional forums, and other communication spaces between participants that the Company makes available through the Website and its services, where such spaces exist and are available.

Use of these spaces is subject to these Rules, the Website Terms of Use, and any additional terms applicable to the relevant service or product, where such terms exist. Information about the processing of personal data is provided in the Privacy and Cookies Policy.

When creating a personal account, the user is required to confirm that they have read and understood the Website Terms of Use, the Privacy and Cookies Policy, and the Forum and Community Rules, and that they agree to them, accept the terms and rules applicable to them, and undertake to comply with them.

These Rules apply in their updated form in accordance with Section 11, including to users who created a personal account before an update.

In these Rules, the "Company" means COMO UM NATIVO, UNIPESSOAL LDA.

2. Purpose of the Forums and Relevance of Posts

The general community forum is intended for community discussions, sharing experiences, and discussions appropriate to its nature. Professional forums are intended for the topics and products to which they relate, in accordance with the framework established for them.

Questions and content must be posted in the appropriate place for their subject matter. Posting materials and/or questions from the Company's courses and products in the general forum is strictly prohibited, as detailed in Section 6.

Do not post repetitive messages, flood discussions, or post the same content in multiple places unnecessarily. Use a relevant title and keep contributions related to the subject of the discussion.

The existence of a forum, the posting of a message, or a question addressed to a user, administrator, or staff member does not guarantee a response, professional review, or an answer within any particular period. Guidance or support services will be provided in accordance with the terms applicable to them, where included in a product or service.

3. Language Areas

Forums may be organised by language, topic, or learning framework. In an area designated for a particular language, discussions must be conducted in that language, except for occasional use of another language where needed for an explanation, translation, example, or relevant discussion.

Organisation by language is intended to structure discussions and does not, in itself, establish privacy settings or restrict viewing between users.

4. Respectful Conduct and Prohibited Uses

Participants and individuals holding roles within the Website must be treated respectfully, and constructive discussion must be allowed even where disagreements arise.

Do not publish content or engage in any use that harms users, the Company, or the rights of others. The following are prohibited, without limitation:

Harassment, threats, humiliation, insults directed at others, hate speech, discrimination, or incitement.

Nudity, sexually explicit content, graphic violence, or other inappropriate content.

Impersonation, misleading representations of affiliation or authority, fraud, or knowingly providing false information with the intention of misleading.

Disclosure of other people's personal information, contact details, private correspondence, or confidential information without appropriate authorisation.

Infringement of the intellectual property, privacy, or other rights of the Company or third parties.

Advertising, promoting, recommending, or referring users to other service providers, suppliers, businesses, teachers, courses, platforms, products, or services without the Company's prior approval. This prohibition applies to overt or covert promotion, including sharing contact details, links, discount codes, and affiliate links, even where the post is presented as a personal recommendation and even where the person posting receives no compensation and has no commercial affiliation. Soliciting customers, fundraising, or posting on behalf of another party without the Company's prior approval is also prohibited.

Spam, flooding, unnecessarily opening duplicate discussions, distributing harmful links, or attempting to disrupt the operation of the space.

Unauthorised collection or use of information about participants or of content, including for copying, distribution, or commercial solicitation.

Circumventing blocks, permissions, or moderation instructions, including through another account or by reposting content that has been removed.

5. Privacy and Sharing Information

Consider carefully what information you publish. The forums are not a private channel for correspondence with the Company. Content published in them, and the profile details displayed alongside it, are visible to anyone who has access to the relevant forum.

The display name in the forums is based on the user's first name and the first initial of their surname. A profile picture is optional. Additional information that a user includes in a message, image, file, or link may identify them beyond the displayed profile details.

Users are advised to avoid publishing personal or sensitive information, payment details, login credentials, identification documents, or information they may not wish to remain in a discussion. Do not publish other people's personal information without appropriate authorisation.

The user is responsible for the content they choose to publish and for obtaining the permissions required to publish it. An image showing one or more minors must not be used as the account's profile picture, even if they appear only partially, incidentally, or in the background.

6. User Content and Intellectual Property

Infringing the intellectual property of the Company or third parties, including rights holders whose content the Company is authorised to use, is strictly prohibited. Copying, photographing, recording, uploading, sending, publishing, distributing, transferring to others, or making protected materials available to others, in whole or in part, without appropriate authorisation is strictly prohibited. This prohibition applies, without limitation, to videos, recordings, files, presentations, workbooks, exercises, questions, solutions, and screenshots. Purchasing a product, participating in a course, or having access to material does not grant permission to distribute or share it.

Publishing or sending materials and/or questions from the Company's courses and products, or questions relating to their content, in the general community forum is strictly prohibited. This prohibition also applies to excerpts, screenshots, recordings, files, links that provide access to materials, and copied or reworded questions and exercises from them.

Where the Company makes available a professional forum or another channel expressly intended for questions and discussions relating to the content of a course or product, it may be used in accordance with its purpose, availability, and the user's access permissions. Nothing in these Rules constitutes a commitment to provide such a professional forum or channel. The absence of a suitable, available option does not permit the material or question to be posted in the general forum.

Even within a professional forum or a dedicated channel, material may be included only to the extent necessary for the discussion and subject to the permissions and terms applicable to it.

A breach of these provisions may result in removal of the content and the enforcement measures set out in these Rules and the Terms of Use, including immediate blocking, whether temporary or permanent, subject to applicable law.

Rights in content published by the user remain with the respective rights holders. Publication does not, in itself, transfer ownership of the content to the Company.

The user represents and undertakes that they hold the necessary rights in the content they publish, or have obtained from the rights holders all permissions necessary for its publication and for granting the Company the licence described below. Uploading, publishing, sharing, or using content without an appropriate right or authorisation, or in a manner that infringes the intellectual property, privacy, or other rights of the Company or third parties, is strictly prohibited. Possessing content, receiving it from another person, purchasing it, or obtaining access to it does not, in itself, grant permission to publish it or authorise others to use it. All publication and use must also comply with these Rules, the Website Terms of Use, and any other applicable terms.

By publishing content in the forums, community spaces, or other areas of the Website intended for publishing and sharing, the user grants the Company a non-exclusive, royalty-free, worldwide licence to use the content, in whole or in part, for the operation, management, development, presentation, and promotion of the Website and the Company's services. This licence includes, without limitation, storage, backup, copying, display, publication, distribution, incorporation into other content, and adaptations involving editing, design, and presentation, whether carried out by the Company itself or through its service providers for these purposes.

This includes the possible appearance of content and discussions in screenshots, screen recordings, demonstration videos, and the Company's informational, educational, promotional, and marketing materials, both on and outside the Website, including on social media and other advertising channels.

Use of the content and any personal data included in it will be subject to the Privacy and Cookies Policy, the Website Terms of Use, any additional terms applicable to the relevant publication or use, and applicable law. Closing an account does not, in itself, terminate the licence in relation to content that the Company may lawfully continue to retain or use.

Content belonging to the Company or other participants must not be used beyond the permission granted, including by copying, distributing, publishing outside the permitted setting, or commercially exploiting it. The intellectual property and user licence provisions in the Website Terms of Use continue to apply.

7. Management and Enforcement

The Company and individuals authorised to act on its behalf may manage the space and take preventive, protective, and enforcement measures to safeguard its operation, participants, and the rights of the Company and third parties.

Such measures may include, without limitation, hiding or removing content, locking discussions, pinning messages, restricting posting or other actions, suspending forum access, and temporary or permanent blocking, in accordance with the relevant permissions, the Company's discretion, the circumstances, and applicable law.

Measures may also be taken where a breach is suspected or to prevent harm. Where circumstances justify it, the Company may act immediately and without prior warning. There is no obligation to provide another opportunity before stopping a breach or preventing harm, subject to applicable legal obligations.

The powers under this section supplement the Company's powers under the Terms of Use and the product terms. The Company may document activity and breaches and retain relevant information in accordance with the Privacy and Cookies Policy and applicable law.

The publication of content, or its continued presence in a forum, does not indicate that the Company has reviewed it, verified its accuracy, or endorsed its contents.

8. Deleting Messages and Closing an Account

A user may delete messages they have posted using the designated deletion tool, where their account permits this and the forum and messages are accessible to them. This option applies to their forum messages and does not include enquiries, messages, or correspondence with the Company retained within the Website's systems.

Before closing an account, users are advised to review their published messages and use the available tools to delete content they do not wish to leave behind. Access may be unavailable to a forum that has been hidden, closed, or is otherwise unavailable, even if it is made available again in the future.

Closing an account does not automatically delete all messages and discussions in which the user participated. Messages that remain may continue to appear under the label "Closed account", without the profile picture. The same applies to the author's identification in the system's built-in reply and quotation displays.

Changing the displayed profile details does not remove identifying information that the user included in the content of their messages. Users should therefore avoid sharing information unsuitable for publication in a community space in the first place.

To request the deletion of content remaining after an account has been closed, users may contact the Company in accordance with the Website Terms of Use, the Privacy and Cookies Policy, any other applicable terms and policies, and applicable law, identifying the account and specifically identifying the forum, message, and information whose deletion is requested. Closing an account does not, in itself, create a commitment to proactively search all forums and locate every item of content published by the user.

9. Information from Participants and Interactions Between Them

Answers, recommendations, links, and content published by participants reflect their own statements and do not, in themselves, constitute a position, recommendation, or commitment of the Company.

Users must exercise their own judgement before relying on information from participants, sharing details, transferring money, or establishing contact outside the forum.

Contacts and meetings independently initiated by users are not activities undertaken on behalf of the Company merely because the users became acquainted through the forum. Users are responsible for their conduct and choices, subject to applicable law.

10. Contacting the Company and Reporting Breaches

For enquiries addressed to the Company, reports of breaches, or requests concerning moderation actions, use the contact methods published on the Website, including the dedicated enquiry tool where available, or email:

contacto@comoumnativo.com

Reports must include details that allow the matter to be identified and examined, such as a link to or the location of the message, a description of the content or activity, and the reason for contacting the Company. False reports and misuse of contact tools are prohibited.

Posting in a forum, including addressing an administrator within a discussion, is not a substitute for contacting the Company through the designated channels. Do not publish account details, transaction documents, or personal information in a forum for the purpose of having an enquiry handled.

Enquiries and correspondence with the Company through the Website's tools are handled and retained in accordance with the Terms of Use and the Privacy and Cookies Policy. Correspondence through external channels, such as email, is not part of the forum message deletion mechanism.

Submitting an enquiry does not, in itself, guarantee a response, acceptance of a request, or handling within any particular period, except where required by applicable law. An enquiry concerning a moderation decision does not, in itself, suspend that decision's effect.

11. Availability and Updates to These Rules

The forums, communication spaces, and features available within them may change, open, close, or be restricted, in accordance with the Terms of Use and the terms applicable to the relevant service or product.

The Company may update and amend these Rules from time to time in accordance with the provisions governing updates to terms in the Website Terms of Use and applicable law.

The current version is the version published on the Website at any given time, unless the Company expressly states otherwise. The updated Rules will apply to use of the forums and all other spaces within their scope from the date of publication, or a later effective date specified for the update, and to all users, including those who created a personal account, published content, or purchased products before the update. The effectiveness of an update is subject to any requirements for notification, advance notice, or further approval applicable under law.

Users must review the updated version and comply with it. A user who does not agree to the applicable Rules must cease using the forums and all other spaces within their scope, subject to applicable law.

Thank you for contributing respectfully, curiously, and constructively to the Como Um Nativo community!
