Terms of Use of the Como Um Nativo Website
Welcome to Como Um Nativo.
The Website allows visitors to learn about the Company’s activities, explore its Products, enjoy publicly available content, create a Personal Hub, and purchase Products and use content and services where these options are offered. The Company’s Products may be supplied through the Website or outside it, depending on their nature and the applicable terms.
These Terms of Use apply to all access to, browsing of, and use of the Website, its content or services, whether the User is registered or unregistered and whether the use is paid or free of charge. Each provision applies according to the nature of the relevant use, service or Product.
Please read these Terms before using the Website. Anyone who does not agree to the terms applicable to their intended use must not engage in that use. Anyone who does not agree to the Website’s Terms of Use is asked to refrain from browsing or using the Website.
When creating a Personal Hub, the User is required to confirm that they have read and understood the Website Terms of Use, the Privacy and Cookies Policy and the Forum and Community Rules, and that they agree to them, accept the terms and rules applicable to them and undertake to comply with them. Purchasing or using certain services may also require acceptance of additional terms, agreements or declarations. These acceptance requirements supplement the general application of these Terms of Use and do not limit their application to registered Users.
1. The Company and Definitions
The Website is operated by:
COMO UM NATIVO, UNIPESSOAL LDA
A company incorporated in Portugal.
Company identification number:
NIPC: 518492680
Share capital: EUR 6,000
Registered office:
Praceta São Francisco Xavier, n.º 2, 4.º A
2685-107 Sacavém, Portugal
Contact email:
Telephone:

In these Terms:
“Company” means the company identified above.
“Website” means the Como Um Nativo website, including its pages, Personal Hub, learning environments, forums, content and services available through it.
“Personal Hub” or “Account” means the personal User account created on the Website following registration, through which its holder can manage their activities with the Company and use the features and services available to them, subject to their permissions and the applicable terms.
“User” means any person who accesses, browses or uses the Website, including an unregistered visitor, a Personal Hub holder, a purchaser or a person authorised to use a Product under its terms.
“Products” means the courses, content, services and products offered by the Company, including physical or digital products, live, recorded or hybrid learning and services, and bundles combining several Products.
“Product Terms” means the terms and information applicable to a particular Product, as presented on its Product page, in the purchase agreement, in annexes and in accompanying documents brought to the customer’s attention as part of entering into the contract.
Provisions concerning a particular type of Product or use apply to that type, as relevant.
2. The Website, the Personal Hub and Product Terms
Parts of the Website are open to the public without creating a Personal Hub. Visitors can, among other things, learn about the Company’s activities, review information about its Products and explore content available for free viewing.
Other content and services may require registration, purchase, the Company’s approval or compliance with additional conditions.
Creating a Personal Hub is free of charge and does not require a purchase. It allows its holder to manage their activities with the Company and use the features offered as part of registration, including community features where available.
Creating a Personal Hub does not, in itself, confer automatic entitlement to the Company’s Products, services or content, or any part thereof, whether supplied on or outside the Website. Entitlement to and use of them are subject to the applicable terms and permissions.
These Terms govern general use of the Website. Certain Products may be subject to additional terms depending on their nature and how they are offered. Such terms may address, among other things and as relevant, matters such as the Product’s scope and contents, price, method of supply, access period, participation requirements and cancellation policy. Product-related terms and information may appear on the Product page, during the purchase process, in a purchase agreement or in accompanying documents, in one or more of these locations.
Where additional terms apply to a Product, they will also be available for review by Users who do not have a Personal Hub on the Website.
If a general provision of these Terms conflicts with a provision expressly addressing a particular Product in the terms governing its purchase, the provision expressly addressing that Product shall prevail, subject to mandatory law.
3. Creating a Personal Hub and User Details
A Personal Hub may be created by persons aged 18 or over who have the legal capacity to enter into a contract.
During registration, the User must expressly confirm that they are at least 18 years old, that they are creating the Personal Hub for themselves and that the information they have provided is accurate. The Company relies on these declarations when creating the Personal Hub and providing services. Providing a false declaration may result in the measures described in these Terms.
Each person may create one Personal Hub for themselves, in their own name and using their accurate details, unless the Company approves otherwise. Users must not create a Personal Hub using another person’s identity, impersonate another person or create additional Accounts to circumvent restrictions, repeatedly claim benefits or evade obligations.
Technical assistance with registration does not change the identity of the Account holder: the Account holder is the person whose details are provided, for whose personal use the Personal Hub is created and who accepts the applicable terms.
Users must provide accurate, complete and up-to-date details and complete the required verification procedures. The User is responsible for updating the details that can be edited in the Personal Hub.
The Personal Hub is associated with its holder and the email address used to create it. The email address associated with the Account cannot be changed.
The User must maintain access to the registered email inbox. Website password recovery is carried out using that email address and in accordance with the recovery procedure available on the Website. Loss of access to the email inbox itself must be addressed with the email provider.
The Account holder’s details are used, among other things, to prepare agreements and declarations during a purchase. Details taken from the Personal Hub cannot be changed within the Product registration process; they must be updated in the Personal Hub before entering into the contract. Where necessary, the User will be asked to provide additional details.
Changes to profile details do not retrospectively alter agreements, declarations or records created previously.
4. Personal Use and Account Security
The Personal Hub is intended for its holder’s personal use. It must not be transferred, sold, rented out or made available for use by others, except for use by a minor expressly authorised under Section 5 and the Product Terms.
The User is responsible for keeping their login credentials confidential, using reasonable security measures and refraining from giving access to unauthorised persons.
The Company must be notified promptly of any suspected Account intrusion, unauthorised use or exposure of login credentials.
To protect Users, the Website, the Products and the Company’s rights, the Company may conduct security checks and take appropriate measures, including requiring additional verification, terminating sessions, restricting activities, suspending access or immediately blocking an Account, depending on the circumstances and in accordance with Section 16.
The Company may investigate activity that raises suspicion of access sharing, circumvention of restrictions or unauthorised use, in accordance with the Privacy and Cookies Policy and applicable law.
5. Purchasing and Using Products for Minors
A minor may not create their own Personal Hub.
For Products where the Company permits this, an adult parent or legal guardian may purchase a Product for a minor through their own Personal Hub, in accordance with the Product Terms and the designated procedure.
The Account holder must indicate that the purchase is intended for a minor, provide the required details and accept the relevant agreement, declarations and annexes. The details of the adult accepting these documents must be those of the Account holder.
Permission is granted only to the minor identified in the purchase documents. It does not permit extending use to other persons, including siblings, friends, relatives, private tutors, accompanying persons or other adults.
The parent or legal guardian is responsible for managing the minor’s access to the Personal Hub and supervising its use, taking into account the minor’s age, maturity and needs and the Product Terms. This responsibility also covers the use of other features available through the Personal Hub, including forums.
Permission to view content together with the minor as part of accompaniment and supervision is granted exclusively to the parent or legal guardian who holds the Personal Hub through which the purchase was made and who accepted the relevant Product Terms, agreement, declarations and annexes. This permission includes learning incidental to such shared viewing and is non-transferable. No other person may be appointed to view the content or accompany the minor on the Account holder’s behalf, even if that person is another parent, another legal guardian or a relative of the minor.
The terms of a particular Product may impose additional requirements, including prior approval for a minor’s participation or the parent’s or legal guardian’s presence during live lessons.
An image of a minor must not be used as the Account’s profile picture.
6. Product Information, Bundles and Offers
The governing information for each Product is the information provided as part of its offer and the contract for its purchase, including its contents, format, method of supply, price and access period.
Contacting the Company, expressing interest in a Product or requesting to join does not, in itself, constitute acceptance or a commitment by the Company to supply a Product. Where the Company’s approval is required, entering into the contract is subject to that approval.
A bundle may contain Products also sold separately, Products offered only within the bundle, or a combination of both. The components included in the bundle and its price will be presented as part of the offer.
The terms applicable to a bundle may comprise bundle-specific terms, the terms of the Products included in it, or a combination of both. These terms may be presented in one or more documents. The purchaser’s acceptance covers all terms presented for their acceptance during the bundle purchase process.
For bundles in which the access periods of the components are combined, the shared access period will be calculated according to the periods included in the bundle and any additional period granted with it. The online content included in the bundle will be available for the final period presented at purchase, starting when access to the bundle is activated.
A shared access period for content does not, in itself, change live lesson dates, delivery dates for physical Products or other conditions unrelated to the online access period.
Coupons, promotions and benefits may be redeemed according to the details presented when they are offered or redeemed and any additional conditions established and presented. Promotions or benefits may not be combined unless expressly permitted.
7. Purchases, Payment and Transaction Documents
The purchase process will present the Product details, price, currency, payment arrangement and applicable additional charges, if any.
Payment is made through payment providers and payment processing services integrated into the purchase process. Payment method details are provided through the payment provider’s secure process.
The payer may be someone other than the Account holder. Use of another person’s payment method requires appropriate authorisation and does not grant the payer any Product usage rights beyond those arising from the purchase agreement.
The Account holder’s details used for the agreement are not necessarily the billing details that will appear on the invoice. Invoice details will be determined based on the information provided for billing and invoicing purposes and in accordance with applicable law.
Where the currency of the payment method differs from the transaction currency, exchange rates and fees imposed by the payment provider or payment method issuer may apply. These matters are subject to the conditions presented during payment and the terms of the relevant providers.
Transaction confirmation and accompanying documents will be provided through means appropriate to the transaction and in accordance with legal requirements, such as the User’s email address, the Personal Hub or other means, individually or in combination.
Following successful completion of payment, the invoice may be generated automatically or through a separate process, depending on the Product, the payer’s details, the transaction details and its circumstances. The invoice may not be issued at the same time as payment confirmation and is subject to the time limits prescribed by law.
8. Instalments, Outstanding Debt and Access Restrictions
Where instalments are offered for a total purchase price, they are an arrangement for paying the amount agreed in the contract. They do not turn the transaction into a subscription that can be discontinued at any time, unless expressly stated otherwise.
The customer must comply with the agreed payment amounts and due dates. Discontinuing use, non-participation, failure to complete studies or not logging in do not, in themselves, cancel the customer’s obligations.
The customer must ensure that their payment method remains valid and settle failed payments, including by updating their payment method through the designated secure process.
The Product Terms and/or purchase agreement will specify, as relevant, any grace period, suspension of access and the possibility of Account restriction due to unsettled debt.
Suspension of access or Account restriction due to debt does not cancel the debt or any further payments agreed in the contract.
Once all overdue amounts have been settled, restrictions imposed due to those arrears will be lifted in accordance with the applicable mechanism. Access to a Product will be restored only if its access period remains valid and there is no separate impediment to restoration.
The original access period continues to run during suspension or restriction due to non-payment. It does not pause, restart or extend because of non-use or lack of access during that period. If the access period has expired before payment is settled, payment does not grant a new access period.
Manually lifting a restriction, granting additional time to pay or providing another concession does not constitute a waiver of the debt unless the Company expressly approves such a waiver.
The Company may pursue collection of amounts owed to it and enforce its rights through lawful means.
9. Access to Products and Scope of Services
Purchasing access to content grants a right to use it in accordance with the Product Terms and does not transfer ownership of the content or its intellectual property rights.
Content may be supplied in stages according to the nature and characteristics of the Product.
Non-use of a Product does not pause or extend its access period.
Viewing access does not include the right to download, record, print or retain copies unless permission has been granted. Permission to download a particular file does not permit its distribution or use beyond the licence granted.
Services such as assignment marking, personal feedback, examinations, private lessons, guidance, educational support or participation in a particular forum are included in a purchase only if expressly stated. Additional services may require scheduling, approval and separate payment.
The Company may determine which members of its team or authorised service providers will deliver the service.
Offering a Product does not oblige the Company to offer follow-on courses, additional services or future contractual arrangements.
Content and benefits provided without commitment as part of a purchased Product may change or cease. This does not detract from content or services promised as part of the purchase.
10. Cancellation, Refunds and Commencement of Supply
The cancellation and refund policy, including any trial period offered, will be determined separately for each Product and presented in its terms.
Creating a Personal Hub or purchasing a Product does not, in itself, grant a trial period, a right to a refund or an option to stop instalments beyond what is provided in the Product Terms or required by law.
Cancellation or refund requests may be sent to the Company’s email address, identifying the Account and transaction. This does not restrict any other method of exercising a right permitted by law.
The Company may, at its discretion, grant a concession, extension, credit, refund or other individual exception. Except for the expressly approved concession and its scope, such a decision does not modify the remaining terms of the agreement under which it was granted, affect their validity or constitute a waiver of the Company’s rights under them. The decision does not alter the terms of other transactions or establish a binding precedent or automatic entitlement to any further concession, whether under the same contract or in other cases.
Neither these Terms nor any Product Terms limit any right of cancellation, reimbursement or remedy that cannot be excluded under applicable law.
11. Intellectual Property and Licence to Use
Rights in the Company’s content, including but not limited to videos, recordings, lessons, texts, presentations, exercises, files, designs, trademarks and the original arrangement of content, belong to the Company or to the rights holders who have authorised their use, as applicable.
Subject to payment and compliance with the terms, the User receives a limited, personal, non-exclusive and non-transferable licence to use the content solely for self-study and in accordance with the Product Terms. Use for a minor is subject to Section 5.
Without appropriate authorisation, Users must not:
- Copy, record, make video screen recordings, download or retain content beyond what is permitted.
- Publish, distribute, transfer, sell, rent out, publicly display or give others access to content.
- Use content to teach others, produce products, services or learning materials, or otherwise exploit it commercially.
- Translate, adapt or create derivative works from protected materials.
- Remove ownership markings, copyright notices, watermarks or identifying features.
- Circumvent access, download or printing restrictions or protective measures.
- Input protected materials into artificial intelligence systems, databases or machine learning systems for training, processing or content generation beyond express permission or a right that cannot be excluded by law.
These restrictions do not prevent personal use of the knowledge and skills acquired and do not exclude exceptions or rights that cannot be waived under applicable law.
12. Recordings and Participant Privacy
The Company’s Products and content may include recordings of lessons, meetings and activities involving students, teachers and others. Recordings may include, without limitation, their image, voice, name, statements, reactions, participation in the learning process and visible surroundings, in any combination. Lessons and meetings may be recorded as part of certain Products and services.
The Company may use recordings for internal, educational, commercial, marketing and other purposes, in accordance with the contractual terms, required permissions and applicable law. Specific provisions concerning recordings and their use may appear in the relevant Product Terms, agreement, declarations or annexes. Where such provisions are included, they apply to the Product and use concerned and prevail over any conflicting general provision in these Terms, subject to mandatory law.
Users must respect the privacy of participants appearing in recordings. Information disclosed in recordings must not be used to harass, humiliate, impersonate, make unwanted contact with participants or otherwise infringe their privacy or rights. Details or excerpts relating to participants must not be extracted from recordings for publication or other unauthorised use.
A User’s participation in a recorded activity, or the inclusion of their image, voice, statements or other personal details in a recording, does not, in itself, grant them ownership of the recording or permission to share it or use it beyond what is authorised. The intellectual property and licence provisions also apply to that User in relation to a recording in which they participated, including an excerpt in which they themselves appear or are heard. In particular, participation does not authorise the transfer of the recording or any part of it to family members, friends or others.
Recording a lesson does not, in itself, entitle a participant to receive the recording. Availability of recordings to participants is determined by the Product Terms or permission granted by the Company.
13. Forums and Forum and Community Rules
Where the Company makes forums or participant communication spaces available through the Website or its services, their use is subject to these Terms of Use and the Forum and Community Rules, which provide further detail and supplement these Terms. The Forum and Community Rules apply to all such spaces, including the general community forum, specialist forums and other participant communication spaces. Users must read the Forum and Community Rules before using these spaces and comply with them.
The Company may update and amend the Forum and Community Rules from time to time in accordance with those Rules, these Terms of Use and applicable law. The updated Rules will apply to use of those spaces from their effective date and to all Users of those spaces, including those who created a Personal Hub, published content or purchased Products before the update, in accordance with the provisions governing updates and their application in those Rules and these Terms of Use, and subject to applicable law.
14. Enquiries and Reports of Violations
The Company may be contacted through the contact channels published on the Website, including without a Personal Hub.
When reporting infringing content or activity, the reporting person must provide information that enables the matter to be identified, including a link or location on the Website, an explanation and relevant details for its examination.
Users must not submit false reports, impersonate others or misuse contact and reporting mechanisms.
The Company may request additional information, examine the enquiry or report and take appropriate measures. An automated acknowledgement, if provided, does not constitute acceptance of any claim or request.
The presentation of contact options on the Website, including in demonstrations or advertising, describes communication channels that may be available to Users. Some channels may be available to all visitors and others only to registered Users. The Company’s contact form is available without a Personal Hub. The availability or presentation of a contact channel does not, in itself, confer a service of personal guidance, advice or a response within a particular period.
Submitting an enquiry or request does not, in itself, guarantee a response or that the request will be granted, except where required by applicable law.
The Company may impose limits on the use of contact channels, including but not limited to the number of characters in an enquiry, the ability to reply to the Company’s responses, the number of replies within a single enquiry and the ability to attach different types of files, such as images and videos.
Duplicate enquiries concerning the same matter must not be opened. Where additional information or further contact is necessary, Users should use the existing enquiry where that option is available, or identify the previous enquiry and avoid unnecessary repeated submissions.
Technical limitations of a particular form do not prevent contact by email or the exercise of rights through other legally permitted means.
15. Prohibited Uses and Website Security
The Website must not be used unlawfully or in a way that harms its operation, its Users, the Company’s rights or the rights of third parties, including rights holders whose content or assets the Company is authorised to use.
Among other things, Users must not:
- Access Accounts, systems or information without authorisation.
- Disrupt the Website, deliberately overload it or deploy malicious code.
- Exploit faults, security vulnerabilities or errors to obtain unauthorised access, benefits or information.
- Use bots, automated collection tools or similar means without approval, except for uses permitted by law or legitimate accessibility tools.
- Collect information about Users or protected content for distribution, copying, impersonation or unauthorised exploitation.
- Circumvent blocks, Account restrictions or access controls.
- Reverse engineer or attempt to obtain components that are not publicly available, except to the extent that applicable law grants a right that cannot be excluded.
Any discovered security vulnerability must be reported to the Company. Users must refrain from exploiting it or disclosing information obtained through it.
16. Enforcement, Suspension and Blocking
The Company may take preventive, protective and enforcement measures to safeguard the Website, Users, its rights and activities, and the rights of third parties, including rights holders whose content or assets the Company is authorised to use. Such measures may be taken, including but not limited to, in cases of breach of the terms, non-payment, unauthorised use or suspected activity of that kind.
Measures may include, without limitation, removing content, restricting activities, suspending access to a Product, restricting an Account, temporarily blocking an Account or permanently blocking an Account, at the Company’s discretion and according to the seriousness of the matter, the risk and applicable law.
Where circumstances justify it, including but not limited to suspected fraud, security breaches, distribution of materials, impersonation, harassment or ongoing infringing use, the Company may act immediately and without prior notice.
There is no obligation to provide an additional opportunity before stopping a violation or preventing harm, subject to applicable legal requirements.
Account restriction due to debt is distinct from blocking for security or enforcement reasons. Settling debt does not automatically lift a block imposed on separate, independent grounds.
Blocking or suspension does not, in itself, extend a Product’s access period. Lifting a block permits renewed use only where entitlement remains valid.
The Company may document violations and retain relevant information for investigation and enforcement of rights, in accordance with the Privacy and Cookies Policy and applicable law.
A User may contact the Company regarding a decision concerning them. Such contact does not, in itself, suspend the decision’s effect.
17. Availability, Maintenance and Changes
The Company works to maintain the proper functioning of the Website, but interruptions, maintenance, faults or temporary outages may occur.
Use may require a suitable internet connection, device, software or browser.
The Company may update, edit, correct, reword, add, replace, reorganise or remove Products and services, in whole or in part, as well as content and components included in them or offered separately on the Website or within the Company’s offering, and may change their design, structure, order of presentation and means of supply.
Such changes may be made for legitimate reasons, including but not limited to educational updates and improvements, correcting errors, avoiding duplication, adapting to professional or technological developments, improving usability and accessibility, security, protecting privacy and rights, complying with legal requirements or adapting the Company’s offering to operational and business needs. The Company may also cease offering Products or services for new purchases.
Website interfaces, supporting tools and communication options may be updated, changed, replaced or discontinued. Their appearance in screenshots, demonstrations or marketing materials does not, in itself, constitute a commitment to maintain them in the same form over time.
Purchasing a Product does not require every wording, file, recording, design or order of presentation existing at the time of purchase to remain unchanged. Changes to a previously purchased Product will be made in accordance with the contractual terms and applicable law.
A fault or interruption affecting the availability of the Website or a Product does not pause the access period or, in itself, confer an automatic extension, except where required by law or otherwise approved by the Company.
A User experiencing a Website fault that prevents or disrupts access to a purchased Product is asked to contact the Company and identify the relevant Product, describe the fault, state when it occurred and provide any further information that may assist its examination, such as an error message, device and browser details or a screenshot, where possible. An access restriction due to debt or enforcement is not, in itself, a technical fault.
Where the dedicated enquiry tool is available, the “Report” category should be selected. Personal Hub holders are encouraged to submit the report through the enquiry tool in their Personal Hub, where access and that option are available. If it cannot be used, the Company may be contacted by email.
Reporting is intended to allow the Company to identify the fault and examine its circumstances. Users should not assume that the Company is aware of an individual fault that has not been reported. These provisions do not limit Users’ rights under applicable law.
18. Learning Outcomes and External Services
Learning progress depends, among other things, on the learner’s background, effort, practice, persistence and personal circumstances.
Unless expressly committed otherwise, the Company does not guarantee a particular level of language proficiency, passing an examination, certification, employment, eligibility for a particular status or any other personal achievement.
Examples, testimonials and student experiences reflect their individual circumstances and do not guarantee identical results for others.
The Website may include links, embedded content and third-party services. Their use may be subject to those third parties’ terms and policies.
An external link does not, in itself, constitute an endorsement of or commitment by the Company regarding the content of the external website. Using an external provider to supply a Company Product does not diminish the Company’s obligations to the customer under the contract and applicable law.
19. Liability and Its Limitations
The User is responsible for their use of the Website, content and Products, the accuracy of the information they provide and compliance with the terms applicable to them.
To the fullest extent permitted by law, the Company shall not be liable for damage to the extent caused by the User’s provision of incorrect or incomplete details, breach of the terms, unauthorised use, provision of access to others, or a defect in the device, software or internet connection used to access the services for which the Company is not responsible.
To the fullest extent permitted by law, the Company shall not be liable to the User for indirect, incidental, special or consequential damages arising out of or in connection with the Website, content, Products or the Company’s services, including through use, inability to use, interruption, delay or unavailability. These include, without limitation, loss of profits, revenue, business opportunities, goodwill or data, to the extent that they fall within the foregoing categories of damages.
These limitations apply subject to applicable law and do not exclude any liability or rights that cannot lawfully be excluded or limited.
The Company reserves the right to take all lawful measures to protect its rights, including demanding that a violation cease, seeking interim or permanent relief and claiming compensation for damages and costs recoverable by law.
20. Privacy, Cookies and Communications
The collection, use and retention of information and the handling of related rights are detailed in the Website’s Privacy and Cookies Policy.
Cookie preferences can be managed through the Website’s cookie settings area, according to the options described there.
When creating a Personal Hub, the User may choose whether to consent to receiving updates, professional content and marketing content through the designated checkbox. This choice can be changed at any time through the Personal Hub, either by withdrawing previously given consent or by giving consent that was not previously given or was previously withdrawn.
Further details are provided in the Privacy and Cookies Policy.
The Company may send operational and contractual communications concerning the Account, purchases, payments, security and purchased services, in accordance with applicable law.
The User must ensure that their contact details are up to date and check communications sent to their registered email address.
Information such as agreements, confirmations, contact details, transaction details and relevant activity records may be retained, among other purposes, to operate the service, comply with legal obligations and protect rights, in accordance with the Privacy and Cookies Policy and applicable law.
21. Account Closure and Retention of Records
A Personal Hub holder may close their Account using the mechanism available on the Website. Before completion, a warning about the consequences of closure will be displayed, and the User will be required to confirm that they wish to close the Account. Once the process is completed, the Account will be closed and access to it and to the content and services accessible through it will cease.
Account closure results in loss of access to the Personal Hub and to Products and services accessible through it, including Products whose access periods have not yet expired. The User cannot independently reopen the Account.
Closure initiated by the User does not, in itself, entitle them to a refund, cancel existing contracts or extinguish debts or obligations.
If debt exists when the Account is closed, a message will be sent with a means of settling it without logging in. Failure to receive a message, reminder or payment link, or the unavailability of a particular payment mechanism, does not, in itself, extinguish the debt or the agreed payment obligations. The User must take steps to settle payment and, where necessary, proactively contact the Company using its published contact details, including by email, to obtain payment instructions. Settling the debt does not reopen an Account closed at the User’s initiative.
Closing an Account is not the same as deleting all related information and records. The Company may continue retaining information that it is legally permitted or required to retain, including but not limited to contact details, agreements, confirmations, invoices and transaction and activity records. Details of the purposes and periods of retention and related rights are set out in the Privacy and Cookies Policy, subject to applicable law.
Account closure and the record deletion mechanisms described in this section relate to the Account and information stored in the Website’s system. These actions do not, in themselves, delete information held separately in other systems or by parties providing services to the Company, such as invoicing and accounting systems. The retention and handling of such information are subject to the purposes of retention, the applicable obligations and periods, and the law.
As long as an email address remains associated with the Account record retained in the system, it cannot be used to create another Personal Hub. Once the record has been fully deleted, a new registration may become possible; it does not restore the previous Account or its rights.
The Company may consider a request to restore a closed Account where the information still exists and restoration is available. Restoration does not extend access periods or recover information already deleted.
An Account for which no login has been detected for ten consecutive years may be deleted under the Account management policy. Such deletion will not take place automatically where there is a valid entitlement to online access to a Product, outstanding debt or another relevant impediment. Logging in again resets the period of inactivity.
Requests concerning personal information and privacy rights are considered in accordance with the Privacy and Cookies Policy and applicable law, separately from Account closure.
Provisions intended to continue after closure, including those concerning debt, intellectual property, prohibited use and lawful retention of records, remain applicable according to their nature.
22. Updates to the Terms
The Company may update the Website’s Terms of Use and the terms applicable to its services from time to time.
The current version is the version published on the Website, unless the Company expressly states otherwise. Updates take effect upon publication or on the date specified for them, subject to any applicable requirements for prior notice or consent.
The Company may display notifications in the “Important Notifications” section of the Personal Hub concerning updates to the public pages containing the Website Terms of Use, the Privacy and Cookies Policy, the Accessibility Statement, the Forum and Community Rules and Consumer Dispute Resolution information. Such notifications may include a link to review the version published on the dedicated public page, where that page remains available. This is an additional means of notification that the Company may use, without undertaking to operate it or to provide notifications through it of every change, regardless of its extent, the part of a document concerned or the area of the Website where it occurs. The existence or use of this mechanism does not create an obligation to also notify Users by email or through any other channel. This does not affect any notification obligations under applicable law.
The updated Website Terms of Use apply to all Users from their effective date, including Personal Hub holders and customers who have purchased Products or retain active access to them, subject to applicable law. A previous purchase does not, in itself, exempt a User from the rules governing use of the Website.
The provisions of this section governing updates and their application also apply to the Forum and Community Rules, together with the provisions governing updates and their application within those Rules.
Updating the terms of a particular Product or service does not, in itself, modify the terms of previous purchases of that Product or service. Applying a change to an existing purchase will be subject to the amendment provisions of the agreement governing that purchase and applicable law.
A User who does not agree to the terms applicable to them must refrain from the use governed by those terms. This provision does not make the exercise of acquired rights conditional on accepting a change that is not binding on the User under the agreement and applicable law.
23. Languages and General Provisions
The Website’s Terms may be published in Hebrew and English. The versions are intended to reflect the same terms.
If the versions differ, interpretation will take into account the contract, the information presented to the User and applicable law, including mandatory requirements concerning the clarity and interpretation of consumer terms.
Agreements relating to particular Products may contain provisions concerning the language of the contract and accompanying versions. Where the purchase agreement designates a prevailing language, the version in that language shall prevail in the event of a conflict or discrepancy between language versions of that agreement, for that purchase and subject to mandatory law.
Terms, agreements and declarations may be accepted electronically, including by selecting a designated checkbox, clicking an acceptance button or applying an electronic signature, according to the relevant process. Acceptance given in this manner expresses the User’s agreement to the documents and declarations presented for their acceptance. Records of acceptance may be retained and used as evidence of the contract and its contents, in accordance with applicable law.
If a provision is found to be invalid or unenforceable, this does not, in itself, invalidate the remaining provisions to the extent that they can remain effective under applicable law.
The Company’s failure or delay in exercising a right, granting additional time or providing a concession does not, in itself, constitute a waiver of that or any other right, whether in the same matter or in other cases. Any waiver by the Company must be express and in writing and applies only within its stated scope.
The Company may determine and change the identity of the persons or entities authorised to manage and operate the Website on its behalf, subject to applicable law.
